If they didn't have the title, you pay in full for the car, and then you get the car, keys, etc and go home, and then he mails you the title once you receive it. If you give him half now to pay off the loan to get the title, you at least need SOMETHING tangible and legal to hold him to the agreement... otherwise you just handed the guy whatever amount of money for no reason. Like get a legal bill of sale, have both of you sign it, and have it notorized... its a binding a agreement... and you can take him to court over it if he tries to screw you. When I sold my Z, and my Durango... I sold the guy the cars, they gave me the money, and I signed a bill of sale and handed them the keys, and they went home, WITH the car. I then mailed the check to the bank, and waited to receive the title. Sometimes they mail it to you, and then you mail it to the new owner signed, othertimes they can mail it directly to the new owner if you don't have to sign it (i.e. the car is in the banks name ANYWAY, and not yours). So, at the least, if you really want the car, and the guy wants half up front, tell him you'll either give him the full amount and take the car, and he can mail you the title, or a minimum you need a signed & notorized Bill of Sale with all the exact details of the car and the purchase agreement (half now, half later), etc signed. The Z I just bought, the owner needed half up front (personal financial issues) and offered to mail me the title, signed, and my bill of sale signed, back to me before I arrived. I sent him half, he took it to the bank, signed the title & bill of sale, had it notorized, and mailed it back. I had them in my hand Tuesday (10/11/05) and I don't pick the car up until next Tuesday (10/18/05). There is always a way to reach an agreement. If he's not willing to work with you, you probably don't want to deal with him. =(
